Assumption of Risk & Release of Liability 

This waiver applies to all TrailMix activities.  Participants acknowledge and agree to these terms as part of event registration. 

By registering for a TrailMix activity, participants acknowledge that they have reviewed, understand, and agree to this Assumption of Risk & Release of Liability. 

TrailMix Alliance (“TrailMix”) is a Minnesota-based nonprofit organization offering outdoor education, trail stewardship, leadership training, hikes, workshops, and community events. Participation in TrailMix activities involves inherent risks.

1. Acknowledgment of Inherent Risk

TrailMix activities may include, but are not limited to: hiking, trail use, outdoor recreation, trail stewardship and maintenance, use of hand tools or equipment, educational trainings and workshops, community gatherings, and travel to and from event locations.

These activities involve inherent risks, including but not limited to uneven terrain, weather conditions, physical exertion, use of tools, contact with plants or wildlife, actions of other participants, and unforeseen hazards. These risks may result in injury, illness, property damage, or other harm.

2. Voluntary Participation & Assumption of Responsibility

Participation in TrailMix activities is voluntary. Participants are responsible for assessing their own physical, emotional, and medical readiness; bringing appropriate gear, clothing, hydration, and medications; and communicating any needs, limits, or concerns to event leaders. Participation may be paused or ended at any time.

3. Release and Waiver of Liability

To the fullest extent permitted by Minnesota law, participants release and hold harmless TrailMix Alliance, its board members, officers, employees, volunteers, contractors, partners, land managers, and affiliated organizations from any and all claims, demands, actions, or causes of action arising out of or related to participation in TrailMix activities, including claims based on negligence, except where prohibited by law.

4. Medical Acknowledgment & Emergency Care

Participants affirm that they are physically and mentally capable of participating or have disclosed relevant limitations. In the event of illness or injury, TrailMix leaders may seek emergency medical care if necessary. Participants are responsible for any medical costs incurred.

5. Compliance with Instructions & Event Guidelines

I agree to follow all reasonable instructions, safety briefings, guidelines, and directions provided by TrailMix Alliance leaders, volunteers, staff, and partner hosts before, during, and after TrailMix activities and events.

This includes instructions related to:

  • safety procedures and risk management

  • pacing, group movement, and tool use

  • accessibility and inclusion practices

  • site-specific rules set by land managers or partner organizations

  • post-event protocols, including equipment return or incident reporting

I understand that failure to follow instructions may result in my removal from an activity if necessary to protect the safety and well-being of participants, leaders, or the environment.

6. Compliance with Safety & Community Expectations

Participants agree to follow reasonable safety instructions, respect TrailMix community agreements and codes of conduct, and act in a manner that supports the safety and well-being of people and place.

7. Respect for Mission, Values & Community Standards

TrailMix Alliance is committed to creating outdoor experiences that are inclusive, equitable, and welcoming to people of all backgrounds and identities.

By participating in TrailMix activities, I agree to:

  • act with respect, care, and consideration toward others

  • uphold TrailMix’s commitment to inclusion, equity, and shared leadership

  • refrain from harassment, discrimination, intimidation, or harmful behavior

  • respect boundaries, access needs, and differences in experience

  • support a culture of psychological, emotional, and physical safety

I understand that behavior inconsistent with these values may result in removal from an activity if necessary to protect the safety, dignity, or well-being of participants, leaders, or the community.

8. Fees & Refund Policy

I understand that any registration fees paid for TrailMix Alliance events, workshops, or activities are non-refundable, except where TrailMix Alliance cancels the event.

I acknowledge that fees help cover program costs, supplies, permits, and accessibility supports.

9. Minors & Parent/Guardian Consent

Participants under the age of 18 must have a parent or legal guardian review and agree to the TrailMix Alliance Assumption of Risk & Release of Liability on their behalf.

By registering a minor for a TrailMix activity or event, the parent or legal guardian affirms that they have the legal authority to provide consent and that a completed waiver will be submitted as required prior to participation.

TrailMix Alliance reserves the right to deny participation if required parent or guardian consent is not provided.

10. Governing Law

This agreement is governed by the laws of theState of Minnesota.

Parent / Guardian Consent for Minor Participant

TrailMix Alliance (“TrailMix”) offers outdoor education, stewardship activities, leadership trainings, and community events. Participation may involve physical activity, outdoor environments, and inherent risks.

By completing this consent, I acknowledge and agree to the following:

  • I am the parent or legal guardian of the minor participant listed below.

  • I have reviewed the TrailMix Alliance Assumption of Risk & Release of Liability and agree to its terms on behalf of the minor and myself.

  • I consent to the minor’s participation in TrailMix activities and events.

  • I affirm that I have the legal authority to provide this consent.

  • I understand that participation may involve physical exertion, outdoor conditions, use of tools, and other inherent risks.

  • I agree that the minor will follow all reasonable instructions, safety guidelines, and community standards provided by TrailMix leaders and partner hosts.

  • I understand that TrailMix Alliance may deny or discontinue a minor’s participation if required consent is not provided or if safety or community standards are not upheld.
